vzbv files another model declaratory action – Volkswagen is followed by Daimler AG

Bad news for the car manufacturers from Stuttgart. The Federal Association of Consumer Organizations (vzbv) will file a so-called model declaratory action (MFK) against Daimler AG at the Stuttgart Higher Regional Court because of the installation of illegal defeat devices. After the association filed the first model declaratory action against Volkswagen AG in 2018 and brought it to a successful conclusion by settlement in 2019, Daimler customers had also long hoped for appropriate compensation. Now anyone who has bought a Daimler vehicle, whether new or used, can assert claims for damages against the car manufacturer without any risk of costs. Participation in this lawsuit is free of charge for consumers, i.e. private individuals.
