Tesla customers complain about vehicle defects
Tesla customers report serious problems ranging from faulty windshield wipers to unwarranted, extreme automatic braking at speed—so-called phantom braking. These defects are not only a major inconvenience but also a significant safety risk.
Affected customers have the right to assert warranty claims against Tesla and have the defects remedied. In many cases, they also have the option of withdrawing from the purchase contract.

3Tesla causes a stir with high defect rate
Tesla vehicles are increasingly coming under scrutiny due to repeated quality defects. According to the 2024 TÜV report, the Tesla Model 3 had a defect rate of 14.7 percent in its first general inspection, ranking last among two- to three-year-old vehicles. No other car performed worse. Problems with braking, axle suspension, and lighting are particularly common.
Numerous Tesla owners report specific defects such as phantom braking, inaccurate range readings, faulty parking sensors, and irregular gaps. These defects not only compromise vehicle safety but also significantly reduce driving comfort.
Tesla defects: Your legal options
If you discover material defects in your Tesla vehicle, you can assert your warranty claim and request Tesla to remedy the defects. For new cars, this is possible within two years of vehicle delivery. However, for used cars purchased from a dealer, the deadline is only one year.
If Tesla fails to remedy the defect within the specified timeframe, the vehicle can be returned to the manufacturer. The Tesla customer will then receive compensation based on the original purchase price. The only exception is compensation for use, which is deducted for the kilometers already driven.
Incorrect cancellation instructions in Tesla purchase contracts
It is also conceivable that the purchase contracts concluded between March 2022 and April 2023 also contain errors. Due to incorrect cancellation instructions, dissatisfied Tesla customers were able to easily cancel their purchase contracts. Instead of the usual 14-day period, these customers were granted an extended period of up to one year and 14 days after vehicle delivery.
Although an extended right of withdrawal is no longer possible today, buyers of new Tesla vehicles who discover defects can still assert their warranty rights up to two years after the vehicle is handed over.

Greenwashing at Tesla
Environmental protection is an important reason for many electric car drivers to buy. In its advertising, Tesla promises to save millions of tons of CO2. However, many don't realize that Tesla earns billions from the sale of CO2 certificates, thereby actively contributing to the spread of combustion engines.
Many Tesla customers might have chosen not to purchase the vehicle if they had been informed of these environmental impacts at the time of purchase. Tesla owners therefore have the opportunity to challenge this practice and seek compensation.
