The turning point in EA288 emissions scandal There is another reason why the prospects of success with the EA288 are getting better and better. Initially, the courts had ruled in favour of Volkswagen AG through advisory decisions. This meant that no illegal switch-off device was installed in the successor engine to the EA189. However, following the decisive ruling of the OLG Naumburg, there is also a ruling by the Frankfurt am Main Regional Court, in which reference is made to the ruling of the Naumburg Higher Regional Court. For you, this means that the Regional Court is guided by the decision of the Naumburg Higher Regional Court. The latter had identified an impermissible switch-off device in the EA288 engine with regard to the functioning of the engine control and awarded the plaintiff a claim for damages. This is contrary to the opinion of the Federal Motor Transport Authority. The Naumburg Higher Regional Court assumes both that the action was immoral and that it was intentional. This corresponds to the decision of the Federal Court of Justice in the EA189.

With this decision, the regional court opens up the possibility of successfully asserting claims for damages. If other courts follow the example of the OLG Naumburg and the LG Frankfurt am Main, there will soon be a turning point in the emissions scandal. The lawsuits are worthwhile, because the number of consumer-friendly judgments in the EA288 emissions scandal is already rising.
