The VW engine “EA288”: If you lie once, no one will believe you!

VW wants to prevent new wave of lawsuits over successor to scandal engine

Regarding the EA288 engine developed by Volkswagen, internal documents from the company have come to light which show that software for manipulating exhaust emissions on the test bench continued to be installed in this engine at least until the 22nd calendar week of 2016.

The EA288 is the successor engine to the scandalous EA189 engine in the 2-liter vehicles of the VW Group, which made the emissions scandal known. It is available with the Euro 5 and Euro 6 emissions classes and is installed in the following vehicles:

"The internal document, the so-called "decision template for the EA 288", is not the product of the imagination of greedy lawyers - as VW would like to make people believe in a smear campaign on its website. EA288 lawsuits are unsuccessful – no way! VW’s smear campaign misrepresents facts

The large VW Group would like to convince the ordinary man on the street that it is completely hopeless for buyers of a vehicle with the EA288 engine to demand compensation. But the reality is different.

Some regional courts and one higher regional court have already granted claims for damages in relation to vehicles with the EA288 diesel engine, including the OLG Naumburg, the LG Düsseldorf, the LG Offenburg, the LG Regensburg, the LG Munich I, the LG Duisburg, the LG Heilbronn, the LG Darmstadt, the LG Potsdam, the LG Munich II, the LG Münster, the LG Flensburg, the LG Bonn, the LG Aachen, the LG Kleve, the LG Mühlhausen, the LG Gießen, the LG Freiburg, the LG Karlsruhe, the LG Oldenburg, the LG Hagen.

Many other regional courts are undergoing a transformation and are changing their initially dismissive attitude.

The manufacturer's information should not be trusted in this regard. The opinion and findings of the district court judges in Offenburg are particularly unanimous in this regard. In the ruling, the VW Group is expressly reminded of its duty to tell the truth and how the company's lawyers deal with this:

"In this context, it should be added that there is also concrete evidence that the defendant (VW) did not have the clear conscience it recently claimed regarding the test bench recognition...in the trial, it did not initially admit the test bench recognition, but described it as generally incorrect...in addition, the defendant (VW) denied the explicit question of whether a switching logic was installed in the vehicle. The test bench recognition was only admitted after an explicit written request from the court, whereby the further question of whether any changes were made to normal operation following the test bench recognition was initially answered falsely with a "no."

"Perhaps this should also be taken to heart in Wolfsburg for the company's homepage. Four higher regional courts, namely Cologne, Celle, Oldenburg and Munich, have also issued positive notices and evidence orders for car buyers and they are of the opinion that our argument about the manipulation of the EA 288 is anything but unfounded.

In doing so, the judges in the aforementioned higher regional courts rely on the VW-internal "decision template on the EA288", which we have introduced into all EA288 proceedings, in which it is explained how, by recognizing driving curves, steering angles and time recording, the car knows that it is now on the test bench and the exhaust emissions are then reduced."

If this is the case and VW did not play with open cards, then the approval process would have been illegal and the vehicles with the EA288 should not have been registered, let alone sold.

Only VW benefits if no lawsuits are filed – twice!

The diesel emissions scandal is no longer just a nuisance, but has become expensive for VW AG. Despite bold statements, Wolfsburg has still not managed to get the 60,000 or so plaintiffs still involved in individual lawsuits off the table following the landmark ruling by the Federal Court of Justice in May this year. The situation is getting worse instead of easing. The company has so far paid millions of euros for its lawyers alone and now its nerves seem to be frayed, partly because of this.

In fact, almost all 3.0 liter diesel vehicle models from VW, Audi and Porsche, which comply with the Euro 6 emissions standard, have already been recalled by the KBA due to illegal switch-off devices. Further recalls are currently being issued for the group's 3.0 liter models in the Euro 5 emissions standard. Here, too, there are lawsuits and judgments against the car manufacturers.

The company is apparently trying to nip the next wave of lawsuits caused by the EA288 in the bud. The company is launching a media campaign against the consumer lawyers who represent buyers against the company, using outdated prejudices. VW is trying to appear reformed to the outside world.

"The next wave of lawsuits in the emissions scandal seems to be building up in a similar way to the beginning of the scandal in 2016. Even then, we, the lawyers of Rogert and Ulbrich, were largely laughed at for wanting to sue the VW Group and believing that the small companies could win against the big ones. Until May 5, 2020 and the landmark ruling of the Federal Court of Justice. Since then, no one has been smiling. Especially not at VW!"

VW Group promises improvement – but only outwardly!

According to the company's own statement on the VW AG website, which is now defaming the consumer lawyers, "integrity and openly addressing existing problems" are very important within the company. However, an article in the Süddeutsche Zeitung from October 9, 2020, entitled "Clarification not desired", shows that this is probably lived out very differently internally. A former constitutional judge was brought to VW as a board member specifically to clarify the diesel emissions scandal and then apparently sidelined within the company and then shown the door again after a year - without any results.

Dear people in charge of the VW Group - clearing up and overcoming such a scandal with decency is a different matter! If you now have to resort to discrediting the plaintiffs' representatives, that does not exactly show greatness! And certainly not for a global corporation! Decency is owed above all to the victims of the diesel emissions scandal - the little man on the street - your customer!
