Würzburg Regional Court orders Audi to take back an Audi A7

Good news from Würzburg. The local district court has upheld our client's claim. Audi AG must now A7 3.0l with 240 kW and the client € 41.914,- The compensation is calculated from the purchase price less a compensation for use for the almost 41,000 kilometers driven (judgment of June 15, 2021, case number 94 O 2084/20).

KBA recall is pending

The Federal Motor Transport Authority (KBA) issued a recall for the A7 in January 2018. The recall explicitly stated that an illegal defeat device had also been detected for these engines. The pollutant-reducing, so-called rapid engine warm-up function in these vehicles only activates during the NEDC test cycle, the court stated in its reasoning for the ruling. This NOx reduction does not occur in real-world traffic. This ultimately qualifies as test bench detection, just as it did with the EA 189 engine.

Notification of impact only in January 2018

The fact that the car was only purchased in March 2017, after the diesel scandal was uncovered, does not change the claim for damages.
