Requirements and possibilities
German citizenship can be acquired in various ways. According to Section 3 of the German Citizenship Act (StAG), the following options are available: by birth (based on descent or place of birth), by declaration, by adoption, by issuance of a certificate pursuant to Section 15 Paragraphs 1 and 2 of the Federal Expellees Act, or by naturalization. Naturalization is therefore only one of several options for acquiring German citizenship.

Right to naturalization
Requirements according to Section 10 StAG
According to Section 10 of the German Citizenship Act (StAG), foreign nationals are legally entitled to naturalization if they meet the following requirements: They must have lived in Germany habitually and legally for five years, have clarified their identity and nationality, and be committed to the free and democratic basic order and reject unconstitutional and inhumane acts. Furthermore, they must have permanent residency rights, be financially independent (without receiving social benefits), have sufficient German language skills, have no criminal convictions, and be familiar with the German legal and social system.
As of June 27, 2024, it is no longer necessary to renounce one's previous nationality, making dual citizenship possible through naturalization. Under certain conditions, the required period of residence can be shortened: Naturalization after three years is possible if an integration course has been successfully completed or language skills at C1 level can be demonstrated (Section 10, Paragraph 3 of the Citizenship Act). Spouses and minor children can also be naturalized, even if they have not yet been legally residing in Germany for eight years.

Requirements
There are various paths to naturalization for foreign nationals, which can be facilitated or discretionary depending on the individual situation.
Naturalization for spouses and life partners of German citizens
Spouses and life partners of German citizens have the opportunity to apply for accelerated naturalization under Section 9 of the German Citizenship Act (StAG). The requirements for this are three years of legal residence in Germany, German language skills at B1 level, no criminal convictions, their own apartment or accommodation, financial independence without social benefits, and a commitment to the free and democratic basic order. Renunciation of previous citizenship is required, if existing.
Naturalization at the discretion of the authority
Anyone who does not have a legal right to naturalization under Section 10 of the Nationality Act (StAG) may still be naturalized under certain conditions. The decision is at the discretion of the competent authority under Section 8 of the StAG. The requirements are eight years of habitual legal residence in Germany, no criminal convictions, proof of owning a home or accommodation, and the ability to independently secure their own livelihood without social benefits. The authority examines the applicant's individual integration into German society, based on factors including German language skills, social participation, and commitment to the free and democratic basic order.
Special requirements for a shortened period of residence apply to minors, persons without habitual residence, older applicants and persons of social importance in the fields of science, research, business, art, culture, media, sport or public service.
The reform of citizenship law also eliminates the previous requirement of integration into German living conditions, which makes the naturalization process easier for many applicants.

Proof of German language skills for naturalization
German language skills are crucial for integration and naturalization in Germany. In some cases, proof of proficiency may be limited to oral language skills, as the naturalization test is often waived under the new citizenship law. A hardship provision allows for exceptions to the B1 language requirement if acquiring the necessary language skills is permanently difficult or impossible despite serious efforts. If B1 level is required, you can demonstrate this through the following methods: successful participation in an integration language course, certificates such as the Goethe Certificate, telc, or TestDaF, four years of schooling at a German-speaking school, completion of a secondary school (Hauptschulabschluss, Realschulabschluss, or Abitur), completed German-language vocational training, or a degree program at a German-speaking university or university of applied sciences. Hardship regulations for naturalization – exceptions to the requirements
In special cases, the naturalization authority may approve an application even if not all of the requirements of Section 8 of the Nationality Act are met. This particularly applies to former Germans and their minor children living abroad who can be naturalized under Section 13 of the Nationality Act, provided their identity and nationality have been clarified and they have not been convicted of a criminal offense. Likewise, foreigners who habitually reside abroad can be naturalized under Section 14 of the Nationality Act if they meet the other requirements of Sections 8 and 9 of the Nationality Act and have demonstrable ties to Germany that justify naturalization. The possibility of naturalization as a hardship case depends on the individual's circumstances.
