What the Higher Regional Court of Celle decided regarding the commencement of the limitation period for late disability insurance applications
Those who report their occupational disability late do not automatically lose retroactive disability benefits due to the statute of limitations. The Higher Regional Court of Celle clarified in its ruling of January 22, 2026 (Case No. 8 U 65/25) that the statute of limitations only begins when the claim becomes due. A late application alone does not bring this date forward. Rogert & Ulbrich will review whether your insurer's statute of limitations objection is valid.
Why disability insurance applications are often submitted late
Disability insurance isn't always activated immediately when someone is unable to work due to health reasons. Many policyholders initially hope for improvement. Others are on sick leave for an extended period and assume they will soon return to work. Still others simply don't know that their illness could entitle them to a disability pension.
Especially in cases of mental illness, chronic pain, or progressive conditions, it often only becomes apparent after months or years that the limitations are permanent. If benefits are then claimed retroactively, substantial sums can quickly accumulate. Insurers frequently respond by arguing that claims for past periods are time-barred.
Did you report your disability late? That doesn't mean that backdated pension payments are lost.
The decision of the Higher Regional Court of Celle of 22 January 2026
In proceedings before the Higher Regional Court of Celle, an insured party claimed benefits from his occupational disability insurance for past periods. The insurer invoked the statute of limitations and argued that the insured could have submitted his claim much earlier.
The court did not accept this argument. The regular limitation period is three years (§ 195 German Civil Code) and begins at the end of the year in which the claim arose (§ 199 para. 1 German Civil Code). In the case of insurance benefits, the claim arises upon its due date. According to § 14 para. 1 German Insurance Contract Act, monetary payments from the insurer become due as soon as the investigations necessary to determine the insured event and the scope of coverage have been completed.
While a late application postpones these investigations, the Higher Regional Court of Celle (OLG Celle) held that this does not justify shifting the commencement of the limitation period to a fictitious earlier date. Such an advance based on good faith (§ 242 of the German Civil Code, BGB) is only permissible in cases of a qualified breach of good faith by the insured. This requires specific circumstances of the individual case, which the insurer must demonstrate and prove. A mere delay or late notification is insufficient.

What the insurer must prove
The statute of limitations defense is a plea raised by the insurer. The insurer must present and prove the facts that would justify the expiration of the limitation period. If the insurer wishes to bring forward the commencement of the limitation period due to bad faith, it must additionally prove the special circumstances that justify such action.
The situation may be different if the insured has fraudulently deceived the insurer or deliberately withheld information. Simply waiting to see if one's health improves is not comparable. According to the ruling of the Higher Regional Court of Celle, someone who simply reports a problem late is not automatically considered to be acting in bad faith.
Furthermore, the statute of limitations is suspended under Section 15 of the German Insurance Contract Act (VVG) as long as the insurer is reviewing the claim. This suspension only ends when the claimant receives the insurer's decision in written form.
Deadlines can also play a role during the claims review process. Don't let blanket statements about the statute of limitations deter you from pursuing your claim.
Limits of retroactive disability benefits
The ruling does not mean that retroactive disability benefits can be claimed indefinitely. In addition to the statute of limitations, other factors must be considered:
- Insurance terms and conditions: Many insurance policies contain provisions stipulating that if notification of occupational disability is delayed, benefits will only be paid from a later date. Whether such a clause is included in the contract and is legally valid must be examined on a case-by-case basis.
- Proof of the time of entry: The insured person must prove when the occupational disability began. The further back this date lies, the more difficult this proof can become.
- Medical records: Medical reports, discharge summaries and findings from that time are crucial.
- Job description: It must be clearly demonstrated what activity was being carried out at that time and how the illness affected it.
- Obligations to cooperate: Insured persons must cooperate in clarifying the circumstances of their claim. Delays in submitting documents may prolong the investigation.

Here's how to proceed with a retroactive disability insurance application.
If you are only now claiming your occupational disability, you should proceed systematically. A well-prepared application shortens the review process and reduces potential points of contention.
First, gather all medical documents from the onset of your illness. This includes doctor's letters, hospital reports, rehabilitation reports, and sick notes. Then, describe your work at that time as specifically as possible: What were your responsibilities, how much time did you spend on each task, and when were you no longer able to meet the demands of your job?
Also, check your insurance policy for any clauses regarding late notification. Complete the insurer's questionnaires carefully. Contradictory information about the date your disability began can later be used against you. You can also find information on reviewing and pursuing claims on our website.
