The Naumburg Higher Regional Court has sentenced Volkswagen AG to pay damages for intentional and immoral damage. What is special about this is that it is the first time that a higher regional court has ruled on the successor engine to the "scandal engine" EA189, the EA288 with Euro 6 emissions standard, which has also been installed in millions of Volkswagen Group vehicles since 2015.
Invalid driving curve detection detects the test bench and controls different operating modes
Specifically, it was a VW Golf VII 2.0 TDI with Euro 6 emissions standard, in which - according to the opinion of the deciding Senate - an illegal switch-off device was supposed to have been implemented. According to the Senate's detailed statements, this switch-off device, which is installed in the form of a test cycle detection (so-called "driving curve detection"), violates applicable European regulations and also constitutes intentional immoral damage. The immorality of Volkswagen AG's behavior lies in the fact that it acts in the interest of profit, deceives buyers and accepts that they will be harmed.
Increasingly good prospects of success for affected vehicle owners
The ruling shows once again that proceedings against Volkswagen AG, which concern the group's EA288 diesel engine, are significantly more promising than Volkswagen AG itself tries to portray.
