45,000+ EUR compensation for Audi Q5 driver

Audi does not appeal the verdict.

Another victory for consumers in the emissions scandal. In a recent case, the owner of an Audi Q5 with a 3.0l engine sued Audi AG and won.

The Ingolstadt Regional Court sentenced Audi to pay 45,866.81 euros in damages and to take back the manipulated car.

The owner of the vehicle had bought the car new in June 2015 for 58,770 euros and had driven it almost 77,000 km up until the day of the court hearing. With a total mileage of 300,000 km assumed by the court, this results in compensation for use of a good 15,700 euros, which is to be credited to the plaintiff.

The Ingolstadt Regional Court again confirmed that the car manufacturer's conduct violated common decency. The deception served the purpose of avoiding legally and technically sound but more expensive solutions for exhaust gas purification in order to reduce costs - no other motives were explained by Audi, nor were they otherwise apparent. In addition, the car manufacturer had achieved a competitive advantage with the help of the apparently environmentally friendly test bench values. This pursuit of profit at the price of deceiving and disadvantaging customers already gave Audi's actions the character of immorality, the verdict states.

It is astonishing, but Audi AG has not appealed against a ruling by the Ingolstadt Regional Court.

As usual, the VW subsidiary has not appealed against this ruling. Audi One can only speculate as to why this prompted the court not to take further action against the judgment of the Ingolstadt Regional Court.

Is it the costs that will be saved on both sides by this step or is it the likely defeat in court?

A negative side effect of an appeal would be that the proceedings would have dragged on. The vehicle owner would probably have continued to drive the car and could have claimed higher compensation for use. The amount to be paid out by Audi would therefore be significantly reduced.

All affected Audi owners will definitely be happy because they will get their damages reimbursed quicker than expected and will be able to return the car.
