Audi AG was sentenced to pay damages several times in January 2021.
In a recent ruling dated January 15, 2021, AZ 41 O 2193/19, the Ingolstadt Regional Court awarded a plaintiff who had purchased an Audi A6, 3-liter diesel with Euro 6 standard in 2016, damages in the amount of 30,350.00 EUR In its reasons for the judgment, the Ingolstadt Regional Court stated: "...the vehicle in question has an inadmissible switch-off device, which the court is convinced is sufficiently established by the recall notice from the Federal Motor Transport Authority for the vehicle type in question, which is known to the court from other pending proceedings. The recall explicitly refers to the removal of an inadmissible switch-off device."

In fact, almost all 3.0 liter diesel vehicle models from the VW, Audi and Porsche brands with the Euro 6 emissions class have already been recalled by the Federal Motor Transport Authority due to illegal switch-off devices. A plaintiff who had bought her Audi A6, 3 litre diesel, Euro 6 second-hand in October 2018 was also successful in January 2021. In its judgment of January 19, 2021, the Ingolstadt Regional Court (case no. 81 O 2310/19) sentenced Audi AG in this case to 27,863.00 EUR Damages. A special feature of this case is that the vehicle was only purchased after the Federal Motor Transport Authority announced in June 2018 that vehicles of this type were being recalled. In January 2019, Audi AG informed the plaintiff that a software update had to be carried out on her vehicle. In the court's opinion, communications from Audi AG to authorized dealers and press releases about the manipulation of certain vehicle types were not sufficient to eliminate the accusation that Audi AG's behavior towards the plaintiff was immoral. The court therefore considered that the claim for damages for intentional immoral damage by Audi AG was justified even if the car was only purchased at the end of 2018.
