Groundbreaking ruling in the emissions scandal against Daimler

Stuttgart Regional Court provides certainty.

The Daimler AG was sentenced to pay damages by the Stuttgart Regional Court for violating European registration law. The reasons for the judgment clearly state that the vehicle manufacturer's obligations include complying with the specified limit values in real driving conditions under normal operating conditions. The vehicle should therefore never have been registered and sold.

The positive ruling for our client will be groundbreaking for future proceedings, as it makes it clear that the risk of the vehicle being taken out of service existed from the very beginning. What is special about the case: The Stuttgart Regional Court was the first to order a vehicle manufacturer to pay damages in the form of repayment of the purchase price for violating European registration law in the emissions scandal.

In the grounds for the judgment, the Stuttgart Regional Court refers to the manufacturer's obligations under European approval law Articles 4 and 5 of Regulation (EC) No. 715/2017 and states: "According to the relevant supreme court rulings, the limit values mentioned must also be observed in real driving conditions under normal operating conditions."
