235,000 car buyers accept the VW comparison.
With the expiry of the deadline for accepting the VW settlement offer in emissions scandal a historic process has come to an end. For the first time in Germany, the instrument of a model declaratory action was used. Dr. Marco Rogert and Tobias Ulbrich, as leading lawyers in the emissions scandal, together with the lawyers Dr. Stoll, Sauer and Grotz, led the Federal Association of Consumer Organizations' (vzbv) lawsuit against Volkswagen AG, negotiated the necessary framework agreement and brought it to a successful conclusion. 235,000 affected VW customers are now benefiting from this.
The model declaratory action against VW has ended; the settlement proceedings have been concluded. 235,000 eligible customers of the car company have received between 1,350 and 6,257 euros in compensation, depending on the vehicle model and age. In total, the settlement cost VW more than 750 million euros; the original figure was 830 million.
Best chances for individual lawsuits
“Never before have so many consumers been able to benefit at once,” emphasises Klaus Müller, Chairman of the vzbv. Association has withdrawn the model declaratory actionn and thus cleared the way for individual lawsuits. Buyers of VW diesel vehicles with illegal switch-off devices who are registered in the lawsuit register but have not received an offer from VW or have not accepted it can now assert their claims in an individual lawsuit - and without worrying about the statute of limitations.
