3Compensation for data protection violations under the GDPR

How much compensation is available for GDPR violations?
The amount of compensation for data protection violations depends on the specific individual case and on various factors, such as the type and severity of the violation.
Examples from case law illustrate the range of possible compensation:
- In a case in which a health insurance company sent an insured person's health record to an incorrect email address, the Düsseldorf Higher Regional Court ruled that the insured person would receive compensation for pain and suffering in the amount of €2,000 (cf. Düsseldorf Higher Regional Court, judgment of October 28, 2021, case number 16 U 275/20).
- In the case of delayed GDPR information, the plaintiff was awarded compensation of €500 by the Cologne Higher Regional Court (cf. Cologne Higher Regional Court, judgment of July 14, 2022, case number 15 U 137/21).
- The Düsseldorf Labor Court ruled that a plaintiff will receive compensation of €5,000 for incorrect and delayed information about processed data after the termination of the employment relationship (cf. ArbG Düsseldorf, judgment of March 5, 2022, case number 9 Ca 6557/18).
