Das LG Wuppertal hat die BGH-Rechtsprechung zum Kraftstoffmehrverbrauch auf E-Autos übertragen. Danach ist eine Abweichung von mehr als 10 % von der WLTP-Angabe erheblich und kann zum Rücktritt berechtigen. Maßgeblich ist die Reichweite unter WLTP-Bedingungen, nicht die Alltagsreichweite bei Kälte oder auf der Autobahn. Eine normale Alterung der Batterie wird berücksichtigt. Das Urteil eines Landgerichts bindet andere Gerichte nicht, daher kommt es auf den Einzelfall an.

Welche Beweise brauche ich?

Wichtig sind der Kaufvertrag, Prospekt, Datenblatt oder Konfigurator mit der WLTP-Angabe, Aufzeichnungen zu Reichweite und Ladevorgängen aus Bordcomputer oder App, Werkstattberichte sowie der Schriftverkehr mit Händler oder Hersteller. Das LG Osnabrück hat Daten aus dem normalen Fahrbetrieb als Anhaltspunkte zugelassen. Den endgültigen Nachweis führt im Streitfall meist ein Sachverständiger.

Was wenn mein E-Auto geleast ist?

Die Mängelrechte stehen zunächst der Leasinggesellschaft zu. In den Leasingbedingungen tritt sie diese Rechte in der Regel an Sie ab. Sie können dann selbst gegen den Händler vorgehen. Mein E-Auto ist älter als 2 Jahre — habe ich noch Ansprüche?

Die gesetzliche Gewährleistung gegenüber dem Händler verjährt bei Neuwagen zwei Jahre nach Übergabe. Bei Gebrauchtwagen kann sie gegenüber Verbrauchern auf ein Jahr verkürzt sein. Nach Ablauf der Frist ist ein Rücktritt in der Regel ausgeschlossen. Verhandlungen mit dem Händler können die Verjährung jedoch hemmen. Zudem kommen Ansprüche aus einer Herstellergarantie für die Batterie in Betracht.

Muss ich Nutzungsentschädigung zahlen?

Ja. Bei einer Rückabwicklung müssen Sie sich die gefahrenen Kilometer anrechnen lassen. Die Nutzungsentschädigung wird in der Regel linear berechnet: Kaufpreis mal gefahrene Kilometer, geteilt durch die erwartete Gesamtlaufleistung. Welche Gesamtlaufleistung bei E-Autos anzusetzen ist, hängt vom Einzelfall ab.

At what point does the deviation in range constitute a defect?

The Wuppertal Regional Court has applied the Federal Court of Justice's (BGH) case law on excess fuel consumption to electric cars. According to this ruling, a deviation of more than 10 km/h from the WLTP figure is significant and can justify rescission of the contract. The decisive factor is the range under WLTP conditions, not the everyday range in cold weather or on the motorway. Normal battery aging is taken into account. A ruling by one regional court is not binding on other courts; therefore, each case must be considered individually.

What evidence do I need?

Important documents include the purchase contract, brochure, data sheet or configurator with the WLTP specification, records of range and charging processes from the on-board computer or app, workshop reports, and correspondence with the dealer or manufacturer. The Osnabrück Regional Court has accepted data from normal driving conditions as evidence. In case of a dispute, the final proof is usually provided by an expert.

What if my electric car is leased?

The rights regarding defects initially belong to the leasing company. In the lease agreement, they typically assign these rights to you. You can then take action against the dealer yourself. A valid cancellation of the purchase contract usually also affects the lease agreement. We will review your lease agreement.

My electric car is older than 2 years — do I still have any claims?

The statutory warranty against the dealer expires two years after delivery for new cars. For used cars, it may be reduced to one year for consumers. After this period, rescission of the contract is generally excluded. However, negotiations with the dealer can suspend the limitation period. Claims under a manufacturer's warranty for the battery may also be considered.

Do I have to pay compensation for use?

Yes. In the event of a return, you must have the mileage driven deducted from the compensation. The usage fee is generally calculated linearly: purchase price multiplied by kilometers driven, divided by the expected total mileage. The applicable total mileage for electric vehicles depends on the individual case.

Is the legal effort worthwhile?
