{"id":88648,"date":"2025-03-17T13:03:31","date_gmt":"2025-03-17T12:03:31","guid":{"rendered":"https:\/\/ru.law\/?p=88648"},"modified":"2025-05-28T09:31:20","modified_gmt":"2025-05-28T07:31:20","slug":"temperaturschaden-bei-tiefkuehlgut","status":"publish","type":"post","link":"https:\/\/ru.law\/nl\/temperaturschaden-bei-tiefkuehlgut\/","title":{"rendered":"Over de voorwaarden voor temperatuurschade aan diepvriesproducten; Gekwalificeerde nalatigheid bij gebruik van een koelvoertuig zonder actieve koeling"},"content":{"rendered":"<p>Voor de verwerking van diepvriesproducten gelden strenge wettelijke eisen, met name die welke zijn vastgelegd in artikel 2, lid 4 van de Verordening Diepvriesproducten (TLMV), waarin een constante temperatuur van -18\u00b0C of lager tijdens het transport is vastgelegd. Overtredingen van deze regels kunnen niet alleen gevolgen hebben voor de verkoopbaarheid van de producten, maar kunnen ook aanzienlijke gezondheidsrisico&#039;s voor de consument opleveren. Dit wettelijk kader vormt de basis voor aansprakelijkheidsvraagstukken bij temperatuurschade aan diepvriesproducten, vooral als de vervoerder ernstig in gebreke is gebleven.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-urteil-oberlandesgericht-dusseldorf\">Uitspraak van het Oberlandesgericht D\u00fcsseldorf<\/h2>\n\n\n\n<p>Indien niet wordt voldaan aan de bepalingen van artikel 2, lid 4 van de Verordening Diepvriesproducten (TLMV), waarin is bepaald dat diepvriesproducten na het invriezen tot aan de levering aan de consument op alle plaatsen op het product een temperatuur van -18\u00b0C of lager moeten worden bewaard en dat kortstondige schommelingen van maximaal 3\u00b0C tijdens het transport zijn toegestaan, is het product niet meer verkoopbaar. Juist vanwege de gevolgen voor de levensmiddelenwetgeving en de mogelijke reputatieschade die ontstaat als een handelaar diepvriesproducten op de markt brengt die volgens de levensmiddelenwetgeving niet zijn toegestaan, kan worden aangenomen dat diepvriesproducten niet verhandelbaar zijn als de goederen niet voldoen aan de voorschriften van de levensmiddelenwetgeving. Een zorgvuldige omgang met de TLMV is essentieel om grote risico&#039;s voor de gezondheid van de consument te voorkomen. Indien de vervoerder diepvriesgoederen bij de ontvanger aflevert met een temperatuur boven de -15\u00b0C, is er sprake van schade aan de te vervoeren diepvriesgoederen. De vraag naar de microbiologische toestand van de goederen is daarom niet meer relevant.<\/p>\n\n\n\n<p>Voor het vervoer van diepvriesgoederen geldt dat de vervoerder een geschikt transportmiddel ter beschikking moet stellen. Hij is er dus verantwoordelijk voor dat de goederen te allen tijde conform de contractuele afspraken kunnen worden vervoerd. Dit geldt ook indien er vertragingen optreden waardoor de goederen langer in het transportmiddel moeten blijven. Indien de vervoerder in deze context een voertuig zonder actieve koeling inzet, draagt hij willens en wetens \u2013 in de zin van gekwalificeerde nalatigheid \u2013 het risico van bederf van de goederen in geval van vertragingen in het transport.<\/p>\n\n\n\n<ol start=\"1\" class=\"wp-block-list\">\n<li><\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-fazit\">Conclusie<\/h2>\n\n\n\n<p>Uit de jurisprudentie blijkt dat het gebruik van transportmiddelen zonder adequate koeling een groot aansprakelijkheidsrisico voor vervoerders oplevert. De verplichtingen inzake zorgvuldigheid die voortvloeien uit de TLMV en de verantwoordelijkheid voor het waarborgen van de productkwaliteit tijdens het transport zijn essentieel. Een schending van deze verplichtingen kan niet alleen leiden tot bederf van de goederen, maar kan ook aanzienlijke juridische gevolgen hebben voor alle partijen die bij het transportproces betrokken zijn.<\/p>","protected":false},"excerpt":{"rendered":"<p>Het hof van beroep in D\u00fcsseldorf maakt het duidelijk: overtredingen van de TLMV-voorschriften met betrekking tot de temperatuur van diepvriesproducten tijdens het transport leiden tot verlies van verhandelbaarheid. De vervoerder is verantwoordelijk voor het gebruik van een geschikt koelvoertuig.
