{"id":88355,"date":"2025-03-07T10:16:04","date_gmt":"2025-03-07T09:16:04","guid":{"rendered":"https:\/\/ru.law\/?p=88355"},"modified":"2025-03-07T10:16:04","modified_gmt":"2025-03-07T09:16:04","slug":"bgh-urteil-verstoss-gegen-den-halbteilungsgrundsatz-bei-maklercourtage-fuer-einfamilienhaeuser","status":"publish","type":"post","link":"https:\/\/ru.law\/nl\/bgh-urteil-verstoss-gegen-den-halbteilungsgrundsatz-bei-maklercourtage-fuer-einfamilienhaeuser\/","title":{"rendered":"Uitspraak BGH: Schending van het beginsel van gelijke verdeling bij bemiddelingskosten voor eengezinswoningen"},"content":{"rendered":"<p><strong>Vonnis van 6 maart 2025 \u2013 I ZR 32\/24<\/strong><\/p>\n\n\n\n<p>Uitspraak BGH over makelaarsrecht: Ongeldigheid van een provisieclaim bij ongelijke bemiddelingskosten<\/p>\n\n\n\n<p>De Eerste Civiele Senaat van het Federale Hof van Justitie, dat bevoegd is voor het makelaarsrecht, heeft in zijn uitspraak van 6 maart 2025 (zaaknummer I ZR 32\/24) geoordeeld dat een makelaarscommissie niet geldig is als deze niet voor hetzelfde bedrag door de verkoper en de koper is overeengekomen - indien laatstgenoemde als consument handelt. Dit volgt uit de <strong>\u00a7 656c lid 1 BGB<\/strong> beginsel van gelijke verdeling.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-sachverhalt\">feiten<\/h2>\n\n\n\n<p>Een makelaar had een bemiddelingsovereenkomst gesloten met de kopers van een eengezinswoning. Het onroerend goed, bestaande uit een woongebouw met een kantoorruimte en een garage, werd eerder door de vrouw van de verkoper aan haar nagelaten als bemiddelingsobject. Voor de verkoper gold een andere commissieregeling, maar de kopers moesten een hogere bemiddelingsvergoeding betalen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-prozessverlauf\">proces<\/h2>\n\n\n\n<p>De <strong>Arrondissementsrechtbank D\u00fcsseldorf<\/strong> heeft de vordering van de makelaar tot betaling van commissie afgewezen. De <strong>Hogere regionale rechtbank van D\u00fcsseldorf<\/strong> bevestigde de beslissing, aangezien het bemiddelingscontract tegen was <strong>\u00a7 656c BGB<\/strong> en is daarom nietig. Met haar beroep bij het Federale Hof van Justitie zette de makelaar haar vordering tot betaling voort \u2013 maar zonder succes.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-entscheidung-des-bundesgerichtshofs\">beslissing van het Federale Hof van Justitie<\/h2>\n\n\n\n<p>Het Federale Hof van Justitie bevestigde de ongeldigheid van de commissieovereenkomst. Omdat de makelaar geen gelijke bemiddelingsvergoeding van beide partijen bij de koopovereenkomst had ge\u00ebist, was het contract in strijd <strong>\u00a7 656c lid 1 zin 1 BGB<\/strong> en was daarom in overeenstemming met <strong>\u00a7 656c lid 2 zin 1 BGB<\/strong> leegte.<\/p>\n\n\n\n<p>Bovendien verduidelijkte de rechtbank dat de bepalingen inzake het beginsel van gelijke verdeling ook van toepassing zijn als de makelaar niet rechtstreeks door de verkoper is ingeschakeld, maar door een derde, in dit geval de echtgenote van de verkoper. Dit dient ter bescherming van de consument, aangezien kopers niet benadeeld mogen worden door ongelijke commissieovereenkomsten.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">betekenis van de beslissing<\/h2>\n\n\n\n<p>Met deze uitspraak versterkt het Federale Hof van Justitie de rechten van consumenten bij de aankoop van onroerend goed en maakt het duidelijk dat makelaars de verplichting tot gelijke verdeling van commissies niet kunnen ontduiken door gebruik te maken van omzeilingsconstructies.<\/p>","protected":false},"excerpt":{"rendered":"<p>Het Federale Hof van Justitie heeft
