{"id":86250,"date":"2025-01-14T10:59:31","date_gmt":"2025-01-14T09:59:31","guid":{"rendered":"https:\/\/ru.law\/?p=86250"},"modified":"2025-05-28T09:32:50","modified_gmt":"2025-05-28T07:32:50","slug":"schiffsnachbesserung-im-werkvertrag","status":"publish","type":"post","link":"https:\/\/ru.law\/nl\/schiffsnachbesserung-im-werkvertrag\/","title":{"rendered":"Scheepsreparatie in bouwcontract: Scheepswerf veroordeeld tot schadevergoeding"},"content":{"rendered":"<p>Een defect schip leidt tot een financi\u00eble ramp: door een defecte binnenbekleding was het schip wekenlang buiten gebruik - met aanzienlijke financi\u00eble gevolgen voor de eigenaar.&nbsp;<\/p>\n\n\n\n<p>Uiteindelijk kwam de zaak voor de rechter en de rechtbank van D\u00fcsseldorf oordeelde in het voordeel van de scheepseigenaar: de scheepswerf moest een schadevergoeding van 146.498 euro betalen vanwege het exploitatieverlies.<br>Deze casus laat zien hoe belangrijk het is om bij reparatiewerkzaamheden aan schepen de contractuele garantie na te leven. Indien er sprake is van gebreken die tot aanzienlijk gebruiksverlies leiden, hebben scheepseigenaren recht op schadevergoeding.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-werkvertragliche-gewahrleistung-bei-schiffen-schadensersatz-und-rechtliche-herausforderungen\"><strong>Contractuele garantie voor schepen: compensatie en juridische uitdagingen<\/strong><\/h2>\n\n\n\n<p>De garantie in een arbeidsovereenkomst is essentieel in het bouw- en fabricagerecht. De opdrachtnemer is verplicht om gebreken die zich tijdens de looptijd van de overeenkomst voordoen, te verhelpen. Juist in de maritieme sector, waar schepen blootstaan aan complexe belastingen, is het van groot belang dat gebreken conform de wet worden verholpen.<\/p>\n\n\n\n<p>In een recente uitspraak heeft het Oberlandesgericht D\u00fcsseldorf de rechten van scheepseigenaren versterkt en een eigenaar schadevergoeding toegekend nadat gebrekkig werk tot gebruiksverlies had geleid.<\/p>\n\n\n\n<p>Rechten en plichten bij herstelwerkzaamheden:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Duidelijke deadlines voor klachten<\/li>\n\n\n\n<li>verplichting om professionele reparaties uit te voeren<\/li>\n\n\n\n<li>compensatie voor verlies van gebruik<\/li>\n<\/ul>\n\n\n\n<p>Deze zaak onderstreept hoe belangrijk het is om contractuele garantieclaims af te dwingen en juridische ondersteuning te krijgen bij het repareren van schepen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-der-fall-mangelhafte-schiffsausstattung-olg-dusseldorf-verurteilt-werft-zu-schadensersatz\"><strong>De zaak: Onvoldoende scheepsuitrusting \u2013 H\u00f6ferlandgericht D\u00fcsseldorf veroordeelt scheepswerf tot schadevergoeding<\/strong><\/h2>\n\n\n\n<p>De Hoge Raad van D\u00fcsseldorf heeft een scheepseigenaar in het gelijk gesteld die schadevergoeding eiste vanwege een gebrekkige binnenbekleding van een binnenschip. De scheepswerf werd veroordeeld tot het betalen van 146.498 euro voor het hierdoor ontstane gebruiksverlies. De schade ontstond door een defecte coating op de tankwagen, waardoor er tijdens het transport van biodiesel coatingresten achterbleven. Dit betekende dat het schip enkele weken uit de vaart moest worden genomen. Het werd uitgeladen, schoongemaakt en de coating werd volledig vernieuwd. Het totale verlies aan gebruik bedroeg 55 dagen.<\/p>\n\n\n\n<p>De scheepseigenaar vorderde vervolgens schadevergoeding op basis van de toenmalige liggeldtarieven voor de binnenvaart. De scheepswerf probeerde zich te beroepen op uitsluitingen van aansprakelijkheid in het contract, maar de rechtbank verklaarde deze nietig. De uitspraak bevestigt de hoogte van de schadevergoeding en versterkt daarmee de rechten van scheepseigenaren in geval van gebreken en uitval. Het recht op schadevergoeding voor scheepseigenaren wordt met name benadrukt in het kader van een garantie op grond van een arbeidsovereenkomst.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-fazit-starkung-der-rechte-von-schiffseignern-bei-nutzungsausfall\"><strong>Conclusie: Versterking van de rechten van scheepseigenaren in geval van verlies van gebruik<\/strong><\/h2>\n\n\n\n<p>De uitspraak van het Oberlandesgericht D\u00fcsseldorf bevestigt de toepasselijkheid van wettelijke liggeldtarieven voor de berekening van het verlies aan gebruik van binnenvaartschepen en stelt duidelijke grenzen aan ineffectieve uitsluitingen van aansprakelijkheid in scheepswerfcontracten.&nbsp;<\/p>\n\n\n\n<p>Scheepseigenaren genieten bij gebreken in de uitvoering meer rechten en kunnen schadevergoeding eisen voor het verlies van gebruik als gevolg van gebrekkige uitvoering.<\/p>\n\n\n\n<p>&nbsp;De uitspraak vereenvoudigt de berekening van de schade en benadrukt dat onduidelijke contractbepalingen kritisch worden onderzocht en in het voordeel van de benadeelde partij worden ge\u00efnterpreteerd. <strong>Belangrijk<\/strong>: Documenteer defecten en uitvaltijd zorgvuldig, zodat u uw claims effectief kunt afdwingen.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-ihr-partner-im-schifffahrtsrecht-rechtssicherheit-bei-werftvertragen\"><strong><strong><strong>Uw partner in scheepvaartrecht: Rechtszekerheid in scheepswerfcontracten<\/strong><\/strong><\/strong><\/h2>\n\n\n\n<p>Als ervaren advocaten in het scheepvaartrecht vertegenwoordigen wij booteigenaren in geschillen over bouwcontracten met scheepswerven.
