Het Federale Hof van Justitie (BGH) heeft opnieuw <\/a>positief<\/a> ten gunste van een eiser die door ons wordt vertegenwoordigd. Dit is niet de eerste zaak die wij hebben behandeld en die door het Federale Hof van Justitie is terugverwezen naar de bevoegde lagere rechtbank voor verder onderzoek (Uitspraak BGH van 13.07.2021, Ref.: VI ZR 128\/20<\/a>). Ook ditmaal besliste het BGH dat de zaak terugverwezen moest worden naar het hof voor een nieuwe beslissing (beslissing BGH van 23 februari 2022, dossiernummer VII ZR 602\/21). Concreet gaat het om een gebruikte Mercedes Benz E 350 D Avantgarde Nacht EU6<\/a> (emissieklasse Euro 6), die werd aangeschaft voor een aankoopprijs van \u20ac 69.900,-. Het voertuig is uitgerust met een dieselmotor van de type OM 642 <\/a>uitgerust. <\/p>\n\n\n\n

Noch de regionale rechtbank van Kiel, noch de Hogere regionale rechtbank van Sleeswijk-Holstein kenden in eerste instantie een schadevergoeding toe aan de eiseres die wij vertegenwoordigden. Het BGH bekritiseert echter het feit dat de feitelijke stelling van eiser dat uitlaatgasreiniging<\/a> van zijn voertuig wordt aangestuurd door een softwarefunctie die herkent of het voertuig op de testbank staat en in dat geval een koelmiddel-richttemperatuurregeling (KSR) activeert. Wanneer een KSR wordt geactiveerd, wordt de uitstoot van stikstofoxiden tot het toegestane niveau teruggebracht. <\/p>\n\n\n\n

Testbankherkenningssoftware als startpunt voor immoreel gedrag <\/h2>\n\n\n\n

De BGH maakt duidelijk dat het gebruik van een dergelijke Software,<\/a> die detecteert of het voertuig zich op de testbank bevindt en vervolgens de uitstoot van stikstofoxide vermindert, kan worden beschouwd als een uitgangspunt voor het vermoeden van immoreel gedrag van Daimler AG. Dat wil zeggen dat de uitstoot van stikstofoxiden alleen op de testbank tot een minimum wordt beperkt en niet onder re\u00eble rijomstandigheden op de weg. Daar wordt de wettelijke grenswaarde van 180 mg\/km ruimschoots overschreden. De KSR houdt het koelcircuit kunstmatig kouder en vertraagt de opwarming van de motorolie. Dit resulteerde in een aanzienlijk lagere NOx-vorming en naleving van de grenswaarden op de testbank. Als de motor echter wordt gestart zonder de testbankherkenningssoftware, treedt de KSR niet in werking. Het resultaat: de koelvloeistof en de motorolie warmen sneller op en de stikstofoxide-uitstoot is hoger. <\/p>\n\n\n\n

Deze softwarefunctie is in eerste instantie alleen beschikbaar op \u00e9\u00e9n Mercedes GLK 220 CDI met OM 651 dieselmotor <\/a>vastgesteld. Inmiddels is echter bekend dat dit manipulatie-instrument ook is ingebouwd in Mercedes C-, E- en S-Klasse voertuigen met de OM 642-dieselmotoren. In juni 2019 had de Duitse Bundesautomobilausstelle (KBA) al een offici\u00eble terugroepactie afgekondigd voor ongeveer 60.000 GLK 220 CDI-modellen met de Euro 5-norm. De KBA gaat nu uit van meer dan 700.000 getroffen voertuigen<\/a> uit. <\/p>\n\n\n\n
