Arrondissementsrechtbank Krefeld wijst schadevergoedingsclaim toe in geval van aankoop na ad-hocmelding.<\/h2>\n\n\n\n

De regionale rechtbank van Krefeld heeft een sensationele uitspraak gedaan.<\/p>\n\n\n\n

Ondanks de recente jurisprudentie van de BGH<\/a> Met betrekking tot voertuigen die zijn aangeschaft na de ad-hocaankondiging van de VW-groep in het emissieschandaal eind september 2015, heeft de eigenaar van een Volkswagen<\/a> Tiguan en beval Volkswagen AG de auto terug te nemen en de koopprijs terug te betalen (vonnis van 19 augustus 2020, zaaknummer 2 O 541\/19).<\/p>\n\n\n\n

Hoewel eiser het voertuig pas in augustus 2016 en dus na de ad hoc aankondiging heeft gekocht, heeft hij het rechtstreeks bij Volkswagen AG gekocht en wel als een nieuwe auto.<\/p>\n\n\n\n

Bijna een jaar na de publicatie van de ad hoc-aankondiging kon en moest eiser erop vertrouwen dat hij rechtstreeks bij VW AG een voertuig zonder gemanipuleerde software kon kopen. In tegenstelling tot het sterrenbeeld waarover de BGH<\/a> besloten, werd verwacht dat ook hier weer aan de wettelijke eisen zou worden voldaan.<\/p>\n\n\n\n

De overeenkomstige \u201conschuld\u201d van de kopers, vooral in het geval van nieuwe auto\u2019s en bij rechtstreekse aankoop van de gedaagde, werd op dit moment hersteld. In aanvulling, Volkswagen<\/a> Wanneer een nieuwe auto rechtstreeks wordt verkocht, bestaat \u2013 in tegenstelling tot wanneer een tweedehandsauto van derden wordt gekocht \u2013 de mogelijkheid om aan te geven dat het voertuig in kwestie is aangetast. Tegen deze achtergrond is het gedrag van Volkswagen na de ontdekking van het zogenaamde emissieschandaal niet voldoende om de beschuldiging van immoraliteit te herzien. Vonnis van 19 augustus 2020, zaaknummer 2 O 541\/19.<\/p>\n\n\n\n
