Rather, it can also be a traffic offense under the German Criminal Code (StGB). The StGB contains sections that explicitly refer to road traffic. These include the following cases: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Driving without a license (<a href=\"https:\/\/www.gesetze-im-internet.de\/stvg\/__21.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 21 Road Traffic Act<\/a>)<\/li><li>License plate misuse (<a href=\"https:\/\/www.gesetze-im-internet.de\/stvg\/__22.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 22 Road Traffic Act<\/a>)<\/li><li>Hit and run or leaving the scene of an accident without permission (<a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__142.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 142 StGB<\/a>)<\/li><li>Dangerous interference with road traffic or endangerment of traffic (<a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__315b.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 315b StGB<\/a> and <a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__315c.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 315c StGB<\/a>)<\/li><li>Illegal car racing (<a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__315d.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 315d StGB<\/a>)<\/li><li>Driving under the influence of intoxicating substances (e.g. alcohol or drugs while driving) (<a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__316.html\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 316 StGB<\/a>)<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-fahren-unter-einfluss-von-alkohol-oder-drogen\">Driving under the influence of alcohol or drugs<\/h2>\n\n\n\n<p>Alcohol and drugs in road traffic&nbsp;<strong>are always a serious accusation,<\/strong>&nbsp;which endangers the driving license.<\/p>\n\n\n\n<p>In Germany, the blood alcohol limit is generally 0.5 \u2030. Up to this point, you will be exempt from punishment unless you commit an alcohol-related driving error such as running a red light, driving erratically, or causing an accident. In this case, a blood alcohol level of 0.3 \u2030 can be considered to be relatively unfit to drive. Generally, a distinction is made between<strong>relative<\/strong>and<strong>absolute inability to drive<\/strong>The latter is present from 1.1 per mille. The closer the determined alcohol content is to the limit of absolute driving incompetence of 1.1 per mille, the lower the requirements for proof of the typical alcohol impairment.
