Number of lawsuits in the emissions scandal is increasing \u2013 VW and the media are resisting this.<\/h2>\n\n\n\n

Is it a coincidence that there are now more and more articles about the emissions scandal in many magazines and on the Internet? Probably not.<\/p>\n\n\n\n

In December 2020, the European Court of Justice made it very clear that the installation of thermal windows was illegal. In January 2021, the Federal Court of Justice went on to state that if the car manufacturers had concealed the installation of the thermal window during the approval process, the car companies had acted intentionally. From there, it is not far to a claim for damages for intentional immoral damage, and this affects millions of customers.<\/p>\n\n\n\n

VW's smear campaign against plaintiffs' lawyers misrepresents facts.<\/h3>\n\n\n\n

This is probably why Wolfsburg is now investing a lot in press work and media campaigns to ward off lawsuits and intimidate potential claimants for damages with headlines saying that lawsuits are not worthwhile and have no hope.<\/p>\n\n\n\n

The lawyers who represent individual consumers in court against corporations are also repeatedly targeted. Well, yes, they do cost money that others are not so keen to spend. Legal expenses insurers had to spend hundreds of millions of euros on the diesel scandal. But why have I taken out legal expenses insurance and pay for it every year if I am then not allowed to take legal action?<\/p>\n\n\n\n

VW also complains that the lawsuits are solely the result of the greed of plaintiffs' lawyers and that the courts are overloaded with so many lawsuits. VW wants to position itself as an advocate of the German justice system. But isn't this just a matter of its own interests being concealed with such statements? The question must be asked: who actually triggered the diesel scandal and the resulting lawsuits? The plaintiffs' lawyers, or the fraudulent acts<\/strong> and manipulations<\/strong> by VW and other car manufacturers on millions of vehicles? And now people are actually complaining that there are lawyers who represent the interests of vehicle buyers within the framework of the German legal system and help consumers to get their rights?<\/p>\n\n\n\n

The question of who caused the wave of lawsuits and thus the overload in the courts is therefore very easy to answer.<\/p>\n\n\n\n

Attorney & Partner Dr. Marco Rogert: <\/strong>"In the 6 years of the emissions scandal, it has always been common practice on the part of the VW Group that anyone who did not file a lawsuit with a court or register in the model declaratory action against VW was not taken into account at all, let alone offered a cent in compensation. That was the strategy in the emissions scandal on the part of VW, not the plaintiffs' lawyers."<\/em><\/p>\n\n\n\n

Who should pay the price? The consumer, the little man on the street who bought a car in good faith in the engineering skills? According to VW, he should just carry on driving his manipulated vehicle and leave it alone. Loss of value or not! Large corporations think that vehicle owners and their lawyers should just stop suing. It is so unpleasant and expensive for everyone. Especially for VW! But where is the right to justice after thousands of abuses of trust by victims?<\/p>\n\n\n\n
