Two injured car buyers are happy about compensation<\/strong>.<\/h2>\n\n\n\n

We were able to obtain two interesting judgments in favor of our clients before the Ingolstadt Regional Court.<\/p>\n\n\n\n

In both cases, these are Audis with 3.0l engines.<\/p>\n\n\n\n

In a proceeding, the plaintiff can rely on a amount of<\/strong> 21,239 euros<\/strong> and can take the car to the Audi<\/a> AG (LG Ingolstadt dated 30.10.2020, ref. 31 O 255\/20). He had his Audi Q5 3.0l Euro 6<\/strong> with the fraudulent software in January 2018 for just under 37,000 euros and has since driven a good 60,000 km with it. He was also exempted from paying the remaining loan amount of 7,100 euros.<\/p>\n\n\n\n

In accordance with the case law of the Federal Court of Justice, he has to be credited with a usage fee of almost 9,600 euros for the distance travelled.<\/p>\n\n\n\n

The second Audi case: compensation despite the sale of the car<\/strong><\/h3>\n\n\n\n

The second case is somewhat different. Here, the plaintiff had the car, a Audi A7 3.0l Euro 6<\/strong>, sold it for 31,500 euros during the proceedings. He had bought it in October 2016 for 56,550 euros and had driven it almost 85,000 km.
The court has now sentenced Audi AG to payment of an additional 8,600 euros<\/strong> (LG Ingolstadt dated October 30, 2020, Ref. 51 O 714\/20).<\/p>\n\n\n\n

In both cases, the court was convinced that an illegal defeat device had been used in the engine control software of both models.<\/p>\n\n\n\n

Two judgments in favour of consumers in a very short period of time<\/strong><\/h3>\n\n\n\n

The judges saw the damaging act as the placing of the defective vehicles on the market. Audi AG concealed the illegal software programming, which led to a recall by the KBA. This behavior was classified as immoral and intentional damage. The deception by Audi obviously only served the purpose of cutting costs.<\/p>\n\n\n\n

The car manufacturer has attempted to avoid legally and technically sound but more expensive exhaust gas purification solutions and to gain a competitive advantage by using seemingly environmentally friendly test bench values.<\/p>\n\n\n\n

We are particularly pleased that we were able to obtain the two convictions against Audi AG within a very short period of time. Both lawsuits were filed in the first quarter of 2020 and were concluded at the end of October 2020. Now, despite the fact that the case has not yet become final, we are hoping for an equally quick and problem-free reversal due to the clear legal situation set out by the Federal Court of Justice.<\/p>\n\n\n\n\n\n
